Thank you for using MedCEC to help fulfill your continuing education requirements. The use of our web site (hereinafter referred to as "website") and services provided within our website, constitutes acceptance of our terms of service (hereinafter referred to as "terms") as well as our Privacy Policy. Hereinafter the term "service(s)" shall include, but is not limited to, the use of the website, platform, software, data, courses, quizzes, exams & other materials contained within the website. These terms shall apply equally for any affiliates of MedCEC. From time to time we may update our terms. Any change in our terms shall become effective from the implementation date forward and this change shall not be retroactive. Continued use of the site following a change in our terms constitutes acceptance of the revised terms. Please review our terms on a regular basis for any changes. The date of the most recent update is displayed in the upper left hand corner of the Terms of Use.
Access and Memberships
You must be of legal age of majority in your state of residence to use our website. Subject to compliance with payment of a membership plan, and these terms of use, MedCEC grants the member non-exclusive, non-transferable access to course materials for the period of the membership. Please be aware that these terms of use are governed by the laws of the United States of America and the laws of the State of Florida, while you may be able to access this website from other countries, the laws of the United States of American and the State of Florida may not apply. Should you choose to utilize the services available on this website from another country it is your responsibility to comply with that country's governing laws.
Accountability for Online actions, Behavior and Conduct
When posting materials including comments, reviews, photos, videos and other materials to our website you are solely accountable for the content of those materials. You are responsible for your online actions, behavior and conduct. You warrant that you are posting the material under your true name, screen name and e-mail. You warrant that you own the rights to the material you post, the material is accurate, and that the material is appropriate. You agree not to post material which is defamatory, illegal, obscene, causes injury to others, is threatening, invasive of privacy, infringes on intellectual property rights or copyright laws, or is otherwise inappropriate material. Please only submit or post appropriate content to our site. MedCEC reserves the right to delete any content that we feel, in our sole discretion, is inappropriate. MedCEC will not take responsibility for material posted by you or any third party. You agree to indemnify MedCEC from any and all claims resulting from materials you post to our site. Repeated abuse may result in termination of your membership without notice.
Account Information and Password
In order to establish a membership account and utilize our website you will need to establish a password connected to your e-mail username. This confidentiality of your account information, including your password, is your responsibility. MedCEC cannot be held liable for any loss or damage caused by inappropriate use of your account information. You agree to take full responsibility for all activities which take place under your account. Please make sure that you log out at the end of each session.

MedCEC provides information about the authors of our course materials on our website. While MedCEC does our best to insure that the information provided is accurate, we do not warrant the accuracy of the information.

Consent to Electronic Communication
Members must maintain a functional e-mail address in order to receive electronic notifications from MedCEC. Information concerning your account will be sent to the e-mail address we have on file. Additionally, other forms of electronic communication may be utilized including, text messaging, chat messaging, etc. The use of any method of electronic communication offered by MedCEC constitutes consent to receive electronic communication and acceptance that all notices, agreements, disclosures and other communications provided via electronic communication.
Dispute Resolution by Binding Arbitration & Class Action Waiver
Generally, any concerns that you may have can be resolved by our customer service department. However if MedCEC is not able to resolve your dispute utilizing these avenues, we mutually agree, as a condition of the use of our services, to resolve the dispute utilizing binding arbitration. The Federal Arbitration Act and federal arbitration law apply to this agreement. To begin the arbitration process, you must send a letter requesting arbitration and describing your claim to our registered agent of record. We will provide you with the address or the address may be obtained from the State of Florida, Division of Corporations. The arbitration will be conducted by JAMS Alternative Dispute Resolution (JAMS). JAMS will administer the arbitration under its Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes. Additionally, we each agree that any dispute resolution shall be conducted on an individual basis only, and not as a plaintiff or part of a class, consolidated or representative action. Unless prohibited by law, you agree, that any and all claims, arbitration or otherwise, shall be initiated within one year of the time of the original dispute or be forever barred.
Indemnification
You agree to indemnify and hold harmless, MedCEC, it's affiliates, their respective officers, directors, employees and agents harmless from any and all losses, damages and expenses including reasonable attorney's fees, claims, injuries, death, or actions of any kind occurring from any third party claim relating to your use of our website/service, your violation of these terms, or your violation of the rights of another.
Integration & Severability
These terms of use contain the entire agreement between you and MedCEC. This agreement is non-assignable. This agreement supersedes any prior agreements, understandings, or negotiations, whether written or oral and can only be amended through a written document formally executed by all parties. If any provision of these terms of use is found to be unlawful, or non-enforceable, then that provision shall be regarded as stricken while the remainder of this agreement shall continue to be in full effect.

MedCEC is constantly striving to enhance your educational experience with our web based learning platform. As such, we may utilize web based applications from third party companies. Some of these companies require links ("hyperlinks") to be placed on our website as part of their application. These links to third party websites does not imply that MedCEC endorses their website, product or services, nor does it imply that we have we received sponsorship of any kind from these companies. THE SERVICES WE PROVIDE THROUGH THIRD PARTY WEBSITES ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, TO THE FULL EXTENT PERMISSIBLE BY LAW. Limitation of Liability
AS PERMITTED BY STATE LAW, IN NO EVENT SHALL MedCEC, IT'S PARENT COMPANY, OR IT'S AFFILIATES, BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING USE, OR LOSS OF USE OF THIS WEBSITE, AND LOSS OF DATA. AT NO TIME SHALL MedCEC's LIABILITY EXCEED THE AMOUNT PAID BY A WEBSITE MEMBER TO MedCEC FOR A SERVICE.
WHILE MedCEC WILL MAKE EVERY ATTEMPT TO INSURE ONLY APPROPRIATE CONTENT IS CONTRIBUTED BY OTHER SITE MEMBERS TO OUR SITE. IN THE EVENT THAT INAPPROPRIATE CONTENT IS CONTRIBUTED, WE WILL ASK THE SITE MEMBER TO REMOVE THE INAPPROPRIATE OR OFFENSIVE CONTENT. IF THE CONTENT IS NOT REMOVED BY THE SITE MEMBER, THEN WE WILL REMOVE IT PER OUR TERMS OF USE AND MAY TERMINATE THEIR MEMBERSHIP. IN NO EVENT SHALL MedCEC BE LIABLE FOR INAPPROPRIATE OR OFFENSIVE CONTENT POSTED TO THE SITE BY SITE MEMBERS.
Ownership, Preservation and Transmittal of Documents
MedCEC does not claim ownership of any of your documents, either created by you during use of our site, or other documents which may be upload to our site. MedCEC is required to store certain documents, including, but not limited to, course documents, transcripts, and certificates for specific periods of time depending upon your state of residence. You hereby grant permission to MedCEC to store and utilize your documents as required to provide our services on your behalf, including transmission of your documents to other parties as required. MedCEC utilizes a secure, redundant, electronic document management system for storage and retrieval of your documents. MedCEC is committed to protecting your data. MedCEC's Secure Sockets Layer (SSL) certificate allows site visitors to view our site over a Hyper Text Transfer Protocol Secure (HTTPS) connection which encrypts the connection between your browser and our site protecting the security of your information.
Paid Memberships, Free Memberships and Auto-Renewal of Memberships
MedCEC may offer a variety of ways to access our site. This may include paid memberships, free memberships and trial memberships. Our paid memberships cover a specific period in time and do not auto-renew. No credit card information is stored by MedCEC and the paid membership will automatically terminate at the end of the specific period. Free memberships typically have limited site access and generally will not terminate however MedCEC reserves the right to discontinue free memberships at any time without notice.

Refund Policy
MedCEC has a goal of 100% customer satisfaction with our services. If you are dissatisfied in any way, please let us know and we will refund the value of services purchased and thank you for bringing the problem to our attention. All requests for refund must be made within 30 days from the date of purchase. To request a refund please send a refund request to customersupport@MedCEC.com. Please note, we cannot issue you a refund if we have already submitted more than one completed course to CE Broker.

d) A statement that you feel that the exclusive rights have been violated by material on the website with the specific URL(s) of the infringing material so we may locate it on the website
e) A statement that you have a good faith belief that the use of the material, has not been authorized by the exclusive rights holder, the exclusive rights holder's agent, or the law
f) A statement made by you that, under penalty of perjury in a US court of law, the information contained in the notification is accurate and that you are authorized to act on behalf of the exclusive rights holder

Termination or Restriction of Membership, Modification or Discontinuation of Services
MedCEC, at it's sole discretion, reserves the right to deny, terminate or restrict access to the website, without prior notice, to anyone who violates our terms of use. Additionally, MedCEC, reserves the right to terminate or restrict site membership at any time, for any reason, without notice. Should a paid membership be terminated, or restricted, we will provide you with notice of such termination or restriction to the email address you have previously provided. MedCEC reserves the right to modify or discontinue services at any time. This may be either temporarily or permanent. Members will be notified via email of any permanent discontinuation of services. Notification of permanent modifications may be sent depending on whether these modifications services or performance and will be at the discretion of MedCEC. You agree that MedCEC shall not be held liable to you for any modification or discontinuation of your membership. In the event memberships which have been in effect for less than 30 days, with no completed courses, shall receive a fully refund, equal to the purchase price of the membership as per our refund policy. At any time, you may discontinue your membership. You may request your membership be discontinued by sending an e-mail to [email protected]. Although you do not have to we would like to know the reason you would like to discontinue your membership. For refunds following discontinuation of your membership, please see our "Refund Policy" for terms.
Use of Materials You Submit or Post to our Site
When you submit or post materials to our site (eg blog or by other means), you are granting MedCEC a irrevocable and unrestricted right to use such materials throughout the world without compensation. This includes the right of MedCEC to identify you as the author and provide your screen name (if applicable) and email. .
